Public procurement law is becoming increasingly complex and formalistic. That’s why we advocate providing advice to contracting authorities and bidders before the contract is awarded.
For public authorities awarding public contracts, the choice of procedure, market configuration and preparation of tender documents are of crucial importance.
We provide contracting authorities with expert, rapid and informed legal support, so that strategic choices can be made with full knowledge of the facts. This support is available for all stages of the procedure, from drafting the invitation to tender, reviewing the documents attached to the invitation to tender, the bid evaluation and purging phase, to preparing the award decision.
Where necessary, we also assist contracting authorities before the courts.
We are also at the disposal of bidding companies, whether to defend them before cantonal administrative tribunals or the Federal Court, to provide legal supervision of bids submitted, to check with bidders that the conditions of the invitation to tender have been met, or for more ad hoc advice.
